Terms and Conditions
General Terms and Conditions (GTC) for the Affiliate Programme of AIQ Business Solutions UG (haftungsbeschränkt)
§ 1 Scope of application and subject matter of the contract
(1) These GTC apply to participation in the affiliate programme of AIQ Business Solutions UG (haftungsbeschränkt), Kaiserdamm 7, 14057 Berlin, hereinafter referred to as the "Provider".
(2) The provider offers the AI content creation tool AI Brand Booster, which uses artificial intelligence to facilitate the creation of high-quality texts and enables the automation of content for use on various platforms.
(3) The purpose of the affiliate programme is to refer new customers for the AI Brand Booster tool. Participating partners receive remuneration for each successful referral.
(4) Participation in the affiliate programme is free of charge and non-binding.
(5) The GTC govern the relationship between the provider and the participating partners.
§ 2 Conditions for participation
(1) Only natural or legal persons of legal age are eligible to participate.
(2) Participation takes place by registering on the registration page of the affiliate programme at https://affiliate.ai-brandbooster.com/onboarding.
(3) The provider reserves the right to reject registrations or exclude partners from the programme, in particular in the event of violations of these GTC or fraudulent activities.
§ 3 Remuneration
(1) The amount of remuneration depends on the number of new customers referred and the type of referral, as described on the website https://ai-brandbooster.com/affiliate-program/.
(2) Remuneration is paid either in credits for the AI Brand Booster Tool or in monetary form.
(3) Payment of the remuneration is always scheduled for the 15th of each month for the previous month.
(4) The remuneration is limited to the actual referral of new customers. Remuneration for other activities, such as advertising the affiliate programme, is excluded.
§ 4 Obligations of the partners
(1) The partners are obliged to advertise the affiliate programme of the provider only within the framework of the applicable laws and these GTC.
(2) Partners are obliged to ensure correct and appropriate presentation when advertising the affiliate programme.
(3) The partners are obliged not to make any misleading statements or false promises when advertising the affiliate programme.
(4) The partners are obliged to keep their access data to the affiliate programme secret and to protect it from access by third parties.
§ 5 Liability
(1) The Provider shall be liable in cases of intent or gross negligence in accordance with the statutory provisions. Liability for guarantees is independent of the degree of fault. The provider shall only be liable for slight negligence in accordance with the provisions of the Product Liability Act, due to injury to life, limb or health or due to the breach of essential contractual obligations. However, the claim for damages for the slightly negligent breach of essential contractual obligations is limited to the foreseeable damage typical for the contract, unless there is unlimited liability for injury to life, limb or health or in accordance with the provisions of the Product Liability Act. Any further liability for damages is excluded. Liability in accordance with the above paragraph (1) also applies to breaches of duty by the provider's vicarious agents.
(2) Essential contractual obligations are those whose fulfilment is essential for the proper execution of the contract and on whose compliance the contractual partner may regularly rely.
(3) If the Partner is an entrepreneur, in addition to paragraphs (1) and (2), claims for damages due to slight negligence are excluded, unless they concern essential contractual obligations, damages resulting from injury to life, limb or health or guarantees or claims under the Product Liability Act are affected.
§ 6 Changes to the GTC
The Provider reserves the right to amend these GTC at any time and without stating reasons. The amended GTC shall be sent to the partners by e-mail. The amendments shall be deemed accepted unless the Partner objects within four weeks of receipt of the amended GTC.
§ 7 Final provisions
(1) The law of the Federal Republic of Germany shall apply to the exclusion of the UN Convention on Contracts for the International Sale of Goods.
(2) The place of jurisdiction is Berlin if the Partner is a merchant or legal entity under public law or has no general place of jurisdiction in Germany.
(3) Should individual provisions of these GTC be or become invalid or unenforceable, this shall not affect the validity of the remaining provisions. The invalid or unenforceable provision shall be replaced by a valid and enforceable provision whose effects come closest to the objective pursued by the invalid or unenforceable provision.
